EB-5 Investment: Here's what you need
The investment required to obtain an EB-5 investor visa To get an EB-5 investor visa, the applicant must be able to fulfill some minimum requirements that involve the investment itself, as the amount of money invested, the sources of this money, the reputation of the investor, etcetera. These requirements limit access to this type of visa and ensures the customer the security of living in the country with the largest economy in the world. REQUIREMENT MINIMUM CAPITAL: To qualify for the EB-5 visa, the customer can invest a minimum of USD 500,000.00, provided that the EB-5 investment is directed to a project located in a "Target Employment Area" (TEA is a geographic area that is considered rural, or has an unemployment rate of at least 1.5 times the national average. Each state determines the precise boundaries of a TEA). If the EB-5 investor does not want to invest in a TEA, the minimum investment amount is USD 1,000,000. EMPLOYMENT GENERATION: Another requirement for the EB-5 visa is to create at least 10 full-time jobs for American workers, legal permanent residents or immigrants authorized to work in the United States. Job creation should occur over a period of two years. To raise funds with other clients in a Regional Center EB-5 investors receive the benefit of the creation of indirect jobs. ELIGIBILITY: The Citizenship Service and US Immigration (USCIS) requires the investor to produce documents to prove that they have not been convicted for a crime, and requires that the customer have no financial fraud in its history, and have not previously violated U.S. immigration laws. There are no requirements regarding previous work experience, education, and English proficiency is not obligatory. ANALYSIS OF THE SOURCE OF FUNDS: The USCIS requires a well-documented source of funds, for all the money involved in the EB-5 investment must have been obtained through legal means. This has been the area of the most common problem at the time of application. Many people try to disclose as little information as possible, just to have the file returned with a request for further information. It is better to provide too much information rather than less of it. OTHER REQUIREMENTS: The EB-5 investment must be "At Risk", i.e. fully invested in a project, fund or new company, for a period not less than five years. By US law, the EB-5 investor does not receive any guaranteed return or capital, or have any rights of return of capital. In exchange, the client and his family are given the status of conditional US residents. Since the creation of ten jobs full time is shown, the visa status becomes permanent.
