Family mediation is becoming an increasingly popular way to resolve disagreements after the breakdown of a relationship. As an effective method of settling grievances without going to through the courts, mediation is quick, confidential, and cost-effective.

What Is Family Mediation?

Family mediation is a method of resolving family disputes that have arisen after a divorce or separation. A specially trained mediator is employed to act as a neutral third party, and will help resolve any disagreements and assist in conciliation.

Matters that may be addressed in mediation meetings can cover a range of subjects, from issues over property and possessions, to arrangements regarding finances and children.

Additionally, mediation is increasingly being used to resolve:-

* Disputes between a parent and child;

* Disagreements over care for elderly or seriously ill relatives;

* Disputes over grandparents right to contact with grandchildren;

* Family arguments that have lead to homelessness.

What Does The Mediation Process Involve?

Whatever the nature of the dispute, family mediation offers a simple and cost-effective way of resolving disagreements. The process begins when the conflicting parties each agree upon a qualified mediator to guide proceedings.

The mediator and the two opposing sides then meet in a location agreeable to all those concerned, and the grievances of each party are discussed. Each person explains their concerns and needs to the room, while the mediator ensures that each side is heard fully and fairly. It is vital to remember that the mediator does not have the authority to make decisions on behalf of either party, but is there simply to aid the negotiation of a mutually acceptable agreement.

More often than not, mediation will successfully enable an amicable settlement to be reached. Even so, any agreements made during family mediation are not legally binding. If you wish to make it so then it is possible to apply to the courts (either yourself or through a solicitor) for a 'Consent of Order', which if issued will give your settlement legal authority.

What Are The Advantages of Family Mediation?

Family mediation has many benefits over litigation, which can be expensive, stressful, and time-consuming. The advantages of family mediation therefore include:-

* Speed - meetings take around 60-90 minutes, and the number of meetings will depend on the nature of the conflict. However, usually a settlement can be reach within 1-6 meetings.

* Cost - taking family matters through the courts can be an expensive affair. With mediation, however, you will be informed of expenses before you begin proceedings, ensuring cost certainty.

* Confidentiality - everything discussed during mediation remains private, the only exception being if there is concern that the welfare of a child is at risk.

Reduces conflict - mediation is a less damaging way of resolving disputes than litigation, helping to preserve some form of relationship. This is particularly important where children are involved.
