Is It Necessary To Get a UK Prenup?

The last thing anyone is thinking about when they decide to get married is the prospect of divorce further on down the line. But sadly enough many couples in the United Kingdom, as elsewhere, do end up going down this path.

There could be many different reasons for a divorce, and however hard couples try to avoid it, sometimes it simply turns out to be the only solution.

But while around half of marriages end up in the UK divorce courts, not all of them have a UK prenup or prenuptial agreement to fall back on. This is an agreement that is settled on by the happy couple, before they walk down the aisle together. It is created so that should their marriage end in divorce some time later there will be no arguments over who owns what or who gets what.

Most couples elect not to have a UK prenup, and there could be several reasons for this. If they are both from similar backgrounds and bring similar amounts financially speaking into the marriage, they may decide there is no need to have such an agreement. Similarly some couples decide not to have one anyway, because they firmly believe they will never split up. This is a romantic notion and one that we all hope to be true, but sadly it does happen. Given the statistics above you have a fifty-fifty chance of being right - and the same odds of being wrong.

This highlights the fact that a UK prenup is a good idea for all couples to consider. It is particularly true for those couples where one partner has significantly more financially to bring to the marriage than the other. For example if one partner owns a successful business whereas the other has a part time job, a UK prenuptial agreement would definitely be well advised. Should the couple part, it would protect the wealthier partner from having to lose some of their earnings and business to their soon to be ex-partner.

Many people find it difficult to think in what seems to be a mercenary way in this situation. This is understandable, but a UK prenuptial agreement prepared by specialist divorce solicitors could prevent a lot of fighting and heartache later on down the line. Hopefully you won't need it, but if you do it will be good to know you went to the trouble of arranging a UK prenup before the big day itself. It could make your life together even more secure.
