How Are Probate Fees Calculated?
Probate fees are dependent on the value of the estate. If the estate is worth £5000 or less there are no probate fees to be paid to the Probate Service. This amount would be calculated after the funeral expenses and dept payments have been made. However, the fees payable for estates worth £5000 or more is only £105. It is possible to apply for remission from payment should it be the case that payment with cause you significant financial hardship. It is possible to be offered either a full remission from the fee or a part remission of the probate fee. The application form for the remission of probate is a EX160A which also includes an information booklet letting you know the ins and outs of court fees and whether or not you are required to pay them. This form is readily available from the government website or from your local Probate Registry.
Extra Grants
If you require a second grant of probate for an estate where a grant has already been given this will cost you £20. Extra copies of the grant will cost you £1 to receive should you order them at the same time as the grant of probate; if the copies are issued after you have already received the grant will be £6 of the initial extra copy and £1 for any further copies. Therefore to save yourself money you should carefully calculate the amount of grants you will require when you make your initial application.
How Do I Pay?
Your probate application will not be begun until your fee has been paid and processed or a remission from payment has been granted. Payments can be made by cheque or postal order with payment made out to 'HM Courts and Tribunals Service' with the name of the deceased person written on the back of the cheque. No cash must be sent as a form of payment. You must also make sure you include all your application forms in this envelope and ensure that the full postage has been paid. You should state the number of copies and the type of copies of the grant that you need. There is a checklist for all the things which are required to be included in your application on the back of the application form. The application form is the PA1. Also required will be a form relating to inheritance tax, this will differ depending on whether or not inheritance tax will be due on the estate and details relating to inheritance tax are available on the website.
