New prescription drugs approved by FDA have both a scientific name, known as the generic name, and a name given by the manufacturer, known as the proprietary name of a drug The protected brand name or trademark, registered with the U.S. Patent Office, under which a manufacturer markets its product. It is written with a capital initial letter and is often further distinguished by a superscript R in a circle (®).

Many medications have two names because more than one version of the medicine is available. The brand name is the name given to a medicine by the pharmaceutical company that makes it. This is also called the "proprietary name". The generic or scientific name is the term given to the active ingredient in the medicine that is decided by an expert committee and is understood internationally. This is also called the "non-proprietary name". For example, sildenafil is the generic name of a medicine used to treat erectile dysfunction. Pfizer, the company that makes sildenafil, sells it under the brand name Viagra.

Generic drugs are marketed under a non-proprietary or approved name rather than a proprietary or brand name. Generic drugs are frequently as effective as, but much cheaper than, brand-name drugs. A brand name is a name given to a drug by the manufacturer. The use of the name is reserved exclusively for its owner.

A company that invents a new drug can file a patent. A granted patent allows the company to exclusively manufacture and market the drug for a certain period of time under its own branded name.

Once the patent expires, the drug can be manufactured and sold by other companies as a generic formulation under its generic name or under a new brand name. This means that the same drug may be marketed under several brand names. The length of the patent can vary among countries. In the UK, patents have a life of 20 years.
