The new Immigration System – Tier One

Within the UK there are is a new immigration system coming into play. In the next coming months the new five tier immigration system will be brought into full swing. The new five tier immigration model has a tier for all different migrants depending on aspects such as their skills or the reason that they want to come across to the UK. Within this article we are going to be taking a look at tier one of the new immigration system.

Tier one of the new five tier system is known as Tier One General Highly Skilled worker. This tier is being introduced to replace the current Highly Skilled Migrant Programme. Tier one will operate in similar ways to the Highly Skilled Migrant Programme for the fact that tier one of the new system will also be a point based system and as with the highly skilled migrant programme applicants will be assessed on a range of criteria. The Home Office hopes that the introduction of tier one will attract the brightest and best people to come live and work within the UK in order to help improve and continue to build the British economy.

Tier one of the new immigration system is aimed at the following people:

General - This category applies to highly skilled candidates who wish to enter the UK in order to seek and undertake employment. The one thing that should be remembered about tier one is that you don’t need a sponsorship in place to gain employment within the UK.

Entrepreneurs – Applicants who wish to enter the UK under tier one as an entrepreneur will be investing in the UK economy by starting or taking control of a business. If you are hoping to gain enter to the UK as an entrepreneur you must also be involved in the day-to-day running of the enterprise concerned.

Investors - The Investor aspect of Tier one is aimed at individuals who are hoping to make a substantial investment in the UK.

Post-Study Work - The Post Study Work part of the tier one provides a short-term bridge to working in the UK for the most talented non-EEA national graduates who have completed a course of study in the UK. Unlike the other categories, the post – study work aspect of tier one it is only granted for a maximum of two years which will not count towards permanent settlement in the UK. Candidates who remain in Britain under this category will be obliged to switch their status into another part of the points system as soon as they are able to do so.

In order to be a successful applicant under tier one of the new immigration system you must score 75 points under a points based system. Migrants who are successfully granted leave in the UK under Tier 1 can stay for three years. After three years, a migrant can renew their Tier 1 visa.

The new immigration system was brought about to make the immigration process into the UK easier and to make it clearly to migrants which tier they should be applying under.
