EB-5: Is September 2016 your last chance?
In 2015 over 98% of the Immigrant Visas through the EB-5 program (156 of 9,764 visas), were issued through the EB-5 Regional Center Program. The EB5 Regional Center program is also the clear choice for most Indian investors. The EB-5 Regional Center program is currently due to expire on September 30, 2016. If the EB-5 Regional Center program is not extended on or prior to September 30, 2016, it will simply cease to exist.
The EB-5 Regional Center program has been due to expire a couple of times in the past but has been extended each time. On September 30th things may be different and the EB-5 Regional Center Program may simply be allowed to expire. If the program expires, hundreds of Indian investors will lose the opportunity to obtain an investment-based “green card”.
In order for the EB-5 program to be extended beyond September 30, 2016, the extension needs be authorized by both the United States Congress and the House of Representatives. In the past the program has received support from leading politicians in the United States. However, this time Senior Members of the House of Representatives have demanded significant changes to the EB-5 Regional Center program if it is to be extended beyond September 30. These demands have been made through a written statement, a copy of which is available from our offices. Multiple unsuccessful attempts to negotiate such changes have been made over extensive periods in the past. Given the time period involved and the pending US election, changes seem unlikely to be negotiated before September 30th and it seems as though the EB-5 Regional Center program might simply cease to exist as of September 30, 2016.
