Rights of Consumers under Lemon Laws

Lemon laws are the state laws in the United States, that enables consumers to get a refund or compensation for re-purchase of a new vehicle, if the currently purchased vehicle turns out to be a “Lemon”. A vehicle is termed as a “Lemon”, if it repeatedly fails to meet standards of quality and performance and it cannot be repaired ever after four or more repair attempts. Lemon laws vary from state to state, but their aim in general is to help new vehicle owners who have substantial continuing problems with warranty repairs. If you find yourself in the unfortunate situation of having bought a vehicle that turns out to be a lemon, you can assert certain rights that you have under lemon laws. You have the right to get you money back. According to the law you can exert your right to get back the money, you have spent in purchasing the vehicle. The term “Money Back” includes your down payments, any installments or interest payments, motor registration fees, repair costs, and any loan payoffs. You have the right to get a new vehicle; in case you do not want the money you have spent in purchasing the faulty vehicle. Under Lemon law as a consumer who has a “Lemon”, you are entitled to receive a new vehicle, which is in proper working condition from the manufacturer. You have the right to file a lawsuit, if your vehicle turns out to be a “Lemon” and the manufacturer refuses to buy back your “Lemon”. You have the right to file a lawsuit and you stand to receive double the expenses that you have incurred on the vehicle as a civil penalty. Lemon laws further empower consumers by curbing manufacturers from selling or recycling a “Lemon”. If a manufacturer has re-purchased a lemon and is going to sell it to another consumer, then as per the law he must inform the consumer that the vehicle has certain defects which cannot be repaired. Additionally, the manufacturer must also have the consumer sign a form which states that the consumer has been informed that the vehicle they are buying is a lemon.Ultimately lemon laws are intended to protect consumer right and to encourage vehicle manufacturers to pay strict attention to manufacturing quality.
