Three Traits To Look For When Hiring A Lawyer

by Jeff Rasansky

The medical malpractice lawyer you choose to work on your claim will be the most significant factor in whether you win or lose. To make sure your odds are stacked toward winning, you'll want to look for a few basic qualities in the attorney you hire.

#1: Experience

Every lawyer needs to start somewhere but, preferably, it won't be on your case. Look for an attorney who has filed cases before and, most importantly, who has won cases before. A good attorney will have enough experience that they'll be able to work very efficiently when preparing your case and will be able to argue your case very persuasively.

#2: Integrity

Some of the best lawyers who work physician malpractice cases work on contingency. This means that their clients don't pay any upfront fees. It also means that those same clients pay nothing at all if the doctor can't argue their case successfully or get a settlement. When you're facing medical problems and a lot of expenses, it's the last time that you want to be working with an attorney who will charge you everything they can whether or not they actually win your claim.

#3: Expertise

This comes with experience. A good medical malpractice lawyer is very well versed in medicine themselves, at least as it applies to the law. They're not medical doctors, of course, but they have access to all of the expertise they need to successfully argue your case for you. Make sure you look for a lawyer who understands not only malpractice law, but who also understands that malpractice claims involve information that most people would rather not divulge. A good lawyer has enough expertise and integrity to win your confidence and to allow you to feel comfortable working with them on these claims.

A good lawyer will make all the difference in your claim. Any honest lawyer will tell you that there's no way that they can guarantee that they'll win your case. However, they may be able to help you put together a case good enough to get a settlement, if the doctors insurance company wants to avoid going to court. If not, they can make sure that you're ready to face the jury when it's your time to testify. With a good attorney helping you, you'll feel ready to face anything that comes up with the claim.
