Both the parties associated with the buying and the selling process of a property would be associated with the conveyancing process. The legal obligations are however, is different in each side. If someone is selling the property, it is important to look into the conveyancing process and its subsequent requirements. This would ensure that all legal and financial obligations are all met in the transaction process.

Most of the property sellers would prefer either a professional conveyancer or solicitor who would aid in completing the process. This would ensure that the customer receives a professional level of expertise on the matter. A professional would be aware of the various laws adhering to the real estate. This makes consultation with the real estate agent throughout the selling process an important aspect of conveyancing. It is imperative to search for the registered conveyancer who would be representing your requirements in the selling process. The employed vendor would deal with several obligations that would be the part of the conveyancing process. This would include the following components associated with the real estate.

The first thing that these solicitors would take care of is the documents. The vendor would also be responsible for developing the contract of sale. This would be a task that would need the assistance of an experienced solicitor, conveyancer or a selling agent. The accurate person to aid in this would be dependent on the type of sale. In the case of private sales, it would be the selling agent who would be responsible for drafting the contract. If the customer chooses to sell through the auction, the solicitor or the conveyancer can prepare the contract accordingly. In the same manner, the vendor would provide the official statement that would be construed by these legal practitioners. The buyer does not need to worry about the document, however, they may wish to deal with the title searches and thereby validate all the details in the statement. This would be however, at the sole discretion of the buyer and the solicitor. Other than this, the seller would be responsible for the Certificate of Title. The proprietor should be the one having this document. If there were any kind of mortgage still in the bank, it would be the responsibility of the vendor to help the purchaser with the conveyancing process.

There are also other kinds of legal obligations that the property vendors need to meet. This may however be dependent on certain individual circumstances. For example, when there is a tenant living on the property. If the property needs to be sold vacant, the owner should be informing the tenant so that the premises are vacated by the date of settlement. Tenants have their rights and therefore the owner should ensure that all the legalities are met. Sometimes the owner can also work with property management companies who would be able to provide advice on the matter. It is best to search for the conveyancer who would be having the expertise that would meet the requirements of the owner. The next obligation is that the vendor should provide the property in the similar manner and condition that is stated in the Contract of Sale. This would include all the fixtures that are included in the papers.

The costs of the professional conveyancer would be less than that of a solicitor. The seller would pay less than the buyer would. The risk becomes extremely high if the conveyancer is not hired for the process. The more the number of tasks that these conveyancers would undertake, the higher would be their charges. There are also different rates and therefore it is important to check in advance.
