Will My Insurers Pay Out If I Am Hit By An Uninsured Driver?

If you have sustained a whiplash injury in a car accident and you later find out that the driver responsible for the collision had no insurance, you may be concerned about whether you can still make a claim and whether your insurance company will pay you any compensation. This article seeks to address this issue and aims to put your mind at rest that all is not lost if you are unfortunate enough to have been involved in a collision with an uninsured driver.
It is incorrect to say that if a driver has no insurance you are not able to make a claim. Fortunately, there is an organisation called the 'Motor Insurers Bureau' which was set up specifically to help victims of uninsured and untraced drivers. The Motor Insurers Bureau is funded by all UK motor insurance companies who are only allowed to operate if they belong to the scheme and contribute financially.
Being involved in a collision with a uninsured driver should not affect the value of your claim, or indeed the steps taken to achieve a settlement, it just may take a bit longer than if you were dealing with an insured driver.
You will still be medically examined to ascertain the extent of your injuries and your solicitor will arrange for a report to be prepared by an independent medical expert detailing your injuries. Your solicitor will also ask you for details of all of your losses and expenses which have been incurred as a result of the accident - such as loss of earnings, loss of overtime, travelling expenses (i.e. to medical appointments), parking fees and prescription charges.
Your solicitor will then compare your injuries to those of Claimants in previously settled cases who have suffered similar injuries to your own and who have taken a similar amount of time to recover. Your solicitor will also use a book called the Judicial Stuides Board Guidelines to assess the value of your injury claim.
Your solicitor will then present the medical report and details of your out of pocket expenses to the Motor Insurers Bureau and will invite them to make an offer in settlement of your claim.
Therefore, do not think that just because the driver responsible for the accident (and for your injuries) was uninsured you are not able to make a claim. It is still perfectly possible to do so although the process may not be quite as straightforward as dealing with a driver who has insurance.
