Immigration Rule Alterations October 2013

The home office has made alterations to the Immigration law regulations in October 2013. These adjustments will affect numerous people in a variety of ways. There will be modifications to forms, intra company transfers and other areas. But, many people are troubled with the English language adjustments which came in to existence on or after twenty eighth Oct 2013. The English language alterations will for the most part be in respect to individuals applying for settlement and naturalisation, though it will also have an effect on others in addition i.e. college students. The Knowledge of Language and Life which is known as (KOLL) requirement that had been brought in as a statutory condition in 2005 intended for citizenship purposes. In 2007 the requirement was extended to be used in Indefinite Leave to Remain applications.

The idea underlying the introduction was to expect individuals who are seeking to settle in the United kingdom & become British citizens to demonstrate a commitment to learning English and comprehend British historical past, society and traditions.

The KOLL requirement could have been demonstrated either by taking a test, or by obtaining an English for Speakers of Other Languages (ESOL) certification. But this changed on 28 October 2013.

Changes: There will be 2 parts to the Knowledge of language and KOLL condition from 28th October 2013. Both will have to be met by all applicants for settlement and naturalisation reasons unless of course these people are exempt. Candidates will need to

• pass the Life in the UK test

In addition to

• have a speaking and hearing certification in English at B1 CEFR or higher, or an equal level qualification. The KOLL requirement for settlement purposes:

The usual expectations will be that adults (i.e. those aged eighteen or over) applying for settlement, no matter whether as a main applicant or a dependant, will be required to fulfill the new KOLL condition. Adults that are eighteen or older will be required to meet the latest KOLL requirements. This will include adult children of persons settled in the United kingdom and adult children applying for indefinite leave as a dependant (There are exceptions)

The KOLL condition for naturalisation requirements

People which apply for naturalisation under sec 6(1) and section 6(2) of the British Nationality Act 1981 will be required to meet the new KOLL requirement. (There are exceptions)

The Life in the UK test

The Life in the UK examination is a computer, multiple choice examination. The examination has been and will go on to be presented through the system of assessment centers operated by learndirect on behalf of the Home Office. The booking mechanism will not alter and you can continue to book the test on the net by means of the government website. Since 25 March 2013, the assessment has been centred on the official guide "Life in the United Kingdom: A Guide for New Residents". It will continue to be possible to take the assessment in Welsh or Scottish Gaelic at sites in Wales & Scotland respectively.

There will be no alterations made to the Life in the UK examination.

Lots of people are anxious by the new changes. The ukba are constantly changing bringing up-to-date and altering the policy and regulations so its good to remain up to date with immigration statutes and regulations.
