Discrimination, in all its aspects is a disgrace. It is shameful to know that there are many people with narrow minds.
Different sexual orientation, referring to gays in the community, is one of the hottest topics around. People are trying to make a circus out of people who have different sexual preference.
Gays are not lesser beings. Some people, who are more narrow minded than others, think that gay people refers only to males who wants to be females. This is not so. Even women who want to enter the world of men are also categorized as gay people.
Gay people are just like any straight person. Some of them even have high paying jobs that are beyond our capacity to reach. It just goes to show that they are no different from us. The question now is why discriminate.
Discrimination can stem from insecurity. Some straight people cannot hold a decent job even if their lives depend on it. Others abhor gay people because they feel superior to them. Still, others discriminate out of fear. People still fear what they do not understand.
The federal and state laws try to correct this disgraceful act of discriminating against people with different sexual orientation by making sure that discrimination in all its forms are made illegal.
In the workplace, it is unlawful for an employer to discriminate a person based on race, religion, disability, age or sex. The last part includes sexual orientation. Unless it is a necessary qualification for an employee to be of a certain age, race, religion or sex, discriminating an employee is illegal.
In California, as well as most states, the illegality of discrimination does not start from the existence of working relationship only. The protection against discrimination is imposed even in the process of applying for a job or the qualifications set in any prospective positions. A gay person is specifically protected from harassment in the aspects of:
1. Hiring; 2. Firing; 3. Compensation; 4. Benefits; 5. Promotion; and other 6. Work standards.
If you are a homosexual person and you are given a different application process as compared to other straight applicants, you have already been discriminated against due to your sexual orientation. If this happens, know that the law is on your side and you can definitely file claims for damages against the employer.
