Does Law For Child Custody Aid The Innocent?

The American Psychological Association found that men who beat their wives will fight for child custody twice as much as nonviolent husbands and fathers. And custody is awarded fifty per cent (50%) of the time! Some courts still believe that the law for child custody should include access for the children to both parents as much as possible. This view prevails with some judges in spite of the fact that watching your mother get beat up is a form of child abuse! This is unbelievable.

Forty percent (40%) of ALL girls and women brutally murdered are killed by husbands and boyfriends. Twenty-five per cent (25%) of all violence against women is committed by a partner from home. This translates to anywhere between two and four thousand women sent to the morgue because of abusive men living in the home.

A woman is most vulnerable to an attack when she tells her husband or boyfriend she is breaking the relationship off. She is still in trouble during custody battles. Not long after a friend of mine was divorced, she was beaten by her ex-husband in front of her young son. Her ex never spent a day in jail.

A local law library will have information on individual state statutes on domestic violence. Nationally, the Civil Rights Remedies for Gender-Motivated Violence law was enacted in 1994. This law provides for monetary damages when violent crime is motivated by gender.

Stories of physical abuse are as credible as the perpetrator's denials. Always get photos taken right away, recordings, and copies of police reports. Allegations of violence require concrete evidence to be taken seriously by the courts. Keep a diary and get an advocate that will help you make your case.

A battered woman who does not protect herself and her children from violence may be prosecuted. On the other hand, a woman who is trying to protect herself and her children from violence by denying visitation may be seen as uncooperative in the eyes of a custody court.

Some judges that rule within the framework of law for child custody may not have any experience or training in family law, child development, or mental health or abuse. Many states have statutes that provide for open and loving relationships with abusers.

Judges try to scrutinize the frequency and severity of the abuse to make a balanced decision between safety and maintaining a parent/child relationship. Abusers are often angry at exes that mitigate any restrictions on them.

Hopefully, men who batter women will be seen for the monsters they are and their custody rights terminated. It is unconscionable to think that a man could murder his children's mother and get sole custody. What youngster desires to be influenced by a parent who hits, rapes, stalks, harasses, or is a murderous felon anyway?
