Rescue Enforcers

Historically, judgment recovery specialists have provided a vital function helping people that want a judgment recovered, if their judgment situations didn't interest pure contingency lawyers. When someone isn't an attorney, they cannot represent anyone else, and because of that judgments get assigned to non-lawyer judgment recovery specialists. Many judgment enforcers are professional and responsive, and either will attempt to collect your judgment, or on request will often agree to assign it back to you when they haven't any present or future plan to recover your judgment.

However with the crummy economic mess, some recovery specialists are flaking out. What can be done when your judgment recovery specialist disappears, flakes, or has done nothing with the judgment and refuses to discuss the topic of returning it to you? The answer may be to try to "rescue" your judgment by undoing the assignment to an unresponsive or flaking judgment recovery specialist.

Before you search for a judgment rescue and enforcement solution, or before spending any time or money trying to rescue the judgment, it's important to not waste time on hopelessly bankrupt or broke debtor situations. The more hopeless your debtor situation is, the less important it is to get the judgment returned to you.

There is usually at least two sides to most stories, and many times the judgment enforcer will have good reasons for not assigning back the judgment. As an example, when they spent a lot of time and money on your debtor that seemed to have no observable assets, and the enforcer has recorded liens on property, and their plan is to wait for the debtor to inherit their relative's property. Another case would be when there's another judgment owner's prior wage levy already in progress, which will be satisfied soon, and the recovery specialist is waiting for an upcoming chance to make another wage garnishment attempt.

If the judgment situation seems hopeless, many professional judgment enforcers will assign your judgment back to you upon request. I have seen judgment situations where a recovery specialist assigned the judgment back as it appeared hopeless, a second enforcer took it, and a year later also returned it and said it seemed hopeless, then a third recovery specialist got that judgment assigned to them, and that enforcer recovered that full judgment amount in five months.

To get your judgment assigned back, it's a good idea to offer to pay the judgment recovery specialist their documented court-related costs, and maybe a bit more, to get the judgment returned. If you can find the recovery specialist, try to work out some deal with them. If there is no other solution, and you cannot find the recovery specialist, or they are not reasonable on the concept of returning the judgment to you, the solution may be to try to undo the assignment of the judgment at the same court where you first got it. This most often requires hiring a lawyer, and always requires time, money, and lots of documents.

This problem of flaking enforcers is becoming so common that some judgment enforcers are hiring lawyers to undo specific judgment assignments, when the original judgment creditor contacts them and agrees to later assign their judgment to them for enforcement, or then permits a collection agency's attorneys try to collect their judgment. Most often this can be accomplished with no, or little money paid by the original judgment creditor, although the "rescuing enforcer" will recover their lawyer and judgment rescue-related expenses before dividing any future money that may be recovered.

It's easy to locate and hire an attorney to try to unravel an assignment of judgment, however that is expensive and means you then still need to look for a recovery solution. How can you find a "rescue recovery specialist" that uses their attorneys to rescue, and then recovers your judgment on contingency? Rescuing a judgment away from flaking enforcers, using attorneys retained by new companies is fairly new.

The right way to find a contingency judgment rescue solution is to contact a judgment broker, because they know judgment recovery experts that use lawyers, in each state. Another way is to search the www and contact enforcers until you locate someone who can help. Note that sometimes over time, flaking judgment recovery specialists return and do the right thing, or sometimes you may later find them, and then most, when asked politely, will return your judgment.
