Rejecting Judgment Enforcers
Every year, our company refers a thousand or so judgment creditors to the best judgment recovery professionals. When judgment owners understand that judgment buyers only will pay what (the debtor looks able to afford to pay and could get forced to pay for) a judgment, our company quickly refers the creditor to real buyers.
During the last few years, we have discovered some creditors don't accept recommended quick referrals to judgment professionals (who have the very best long term track records). Certain rejecting judgment owner's reasons were so "hilarious", that I thought they would make an interesting article.
My articles are my opinions and are not, a legal opinion. I'm a judgment expert, and not an attorney. If you ever need legal advice or a strategy to use, you should contact a lawyer. These are the most popular five "silly" reasons judgment owners do not go with a professional judgment referral:
1) "Googled the address of the judgment recovery specialist you recommended to me. His (house or office) was not in a (professional office building or wealthy neighborhood) which means they are not successful enough". Any judgment enforcer's work, home, or mailing address, has nothing to do with their track record of recovering or purchasing judgments. Most judgment experts use a PO address box, not wanting visits by debtors.
2) "I searched the internet, and found a web page with some bad info about the recovery specialist". Because anyone can trash anybody else's reputation on the web, it happens often. Often, the documents shared by a single disgruntled person aren't registered at a court, and just give one embellished version of a (usually at least partially) fabricated version of the story. Anyone who recovers (or brokers) judgments, has several enemies. At our company, if our company sees this, we hear both of the parties, before we rule any expert out. I refer people only to professionals having the best long term records. We do not listen to what a single guy with some problems, puts on the web.
3) "I require an enforcer closer to my debtor". From our years of experience, our company has found that very often the best judgment enforcers tend to be ones that hire lawyers local to the debtors. Whenever our company refers a judgment owner to a professional, our company makes sure it is one who has consistently demonstrated success in collecting or purchasing judgments where the debtor is living. Even when we refer explain this to judgment owners, some of them still do not like the fact the professional may be located in some other state. we know from years of experience, what counts is the "expert's" long term track record.
4) "I did not like that enforcer's paperwork". Judgment recovery and purchases always needs signed documents. Our company has seen the contracts sent by over 500 experts; and certain creditors refuse to sign the simplest, fairest, and cleanest, paperwork we have seen. Some judgment owners will not sign anyone's paperwork, and start their mission wasting vast amounts of time for many judgment professionals; and always unwilling to sign anyone's contract.
5) "The judgment buyer's offer to buy my judgment was an insult, so please get me another buyer". What buyers pay for judgments is dependent just on your judgment debtor's circumstance. No buyer can pay you above what the buyer's own pricing model, based only on your judgment debtor's available assets.
